Ramps in West Virginia: where the State Building Code applies

Ask a neighbor in one West Virginia county whether a porch ramp needs a permit and you may get a different answer than a cousin two counties over. That is not confusion. It is how the state's building code is designed.

Below is the statute that explains it, followed by what the weather means for a ramp surface and the products we would consider for a West Virginia doorway, home or church.

A state code that counties and cities opt into

The State Fire Commission writes West Virginia's State Building Code under W. Va. Code §15A-11-5. Subsection (a) says the rules shall "have force and effect in those counties and municipalities adopting the State Building Code," and that "each county or municipality may adopt the code to the extent that it is only prospective and not retroactive in its application." In other words, the code reaches your house only if your county or city has adopted it.

Where it has, enforcement is local. Subsection (d) states: "Enforcement of the provisions of the State Building Code is the responsibility of the respective local jurisdiction," and lets a county or city contract with another for inspection and enforcement. Subsection (c) allows a stricter local ordinance to govern if it is not inconsistent with state law, and gives the State Fire Commission the final word on which rule takes priority in a dispute. Buildings "utilized primarily for agricultural purposes" are exempt.

So the first question for a ramp is not about slope or railings. It is: has your county or municipality adopted the State Building Code, and does its building office require a permit for this kind of work? Your county commission office or city hall can tell you who issues permits where you live. If the answer is that nothing is adopted where you live, building with care still matters, because a ramp is used by the people least able to recover from a fall.

For renters, we looked for West Virginia's fair housing rule on reasonable modifications and found that the Fair Housing Act sections we checked, including §5-11A-5, appear as repealed in 2024 on the Legislature's site. We could not confirm where those provisions now sit, so we are not quoting a rule here. Get any landlord's permission in writing before work starts.

What the climate asks of a ramp

The NOAA West Virginia summary says the central part of the state receives "50 or more inches of precipitation per year," that the mountains average 100 inches of snow, and that ice storms and flooding are among the state's recurring extremes. Total precipitation was highest in the 2016 to 2020 period, averaging 51.9 inches. A ramp here will often be wet, sometimes icy, and occasionally under water. Grip, drainage and a covered landing at the door matter as much as length.

Some steps help in any season. Keep the ramp surface free of leaves and moss, give rainwater somewhere to go other than the landing, and keep a bucket of grit or a stiff broom by the door for icy mornings. If the house sits low near a creek or river, think about where the ramp ends and whether that ground floods. NOAA projects winter and spring precipitation to increase in the state, so planning for wet ground is planning for the likely case.

Questions about ramps in West Virginia

Do I need a permit for a wheelchair ramp in West Virginia?

That turns on your county or city. Under §15A-11-5, the State Building Code has force only in counties and municipalities that adopt it, and enforcement is "the responsibility of the respective local jurisdiction." Ask your county or city whether it has adopted the code and what it requires for your project.

Who has the final say if local and state building rules conflict?

§15A-11-5(c) lets a stricter state law or local ordinance govern if it is consistent with West Virginia law and good engineering practice, and says the State Fire Commission's decision "determines the relative priority" of the rules and compliance by officials. Your local building office is still the place to start.

Will a threshold ramp work on a West Virginia porch?

For a lip or a single small step, often yes. Harmar's Rubber Threshold Ramp covers rises up to 4 in with non-slip rubber and an 850 lb capacity. NOAA describes heavy precipitation, snow and ice storms across the state, so keep it clear of standing water and ice.

Can a church in West Virginia use an automatic door opener?

The Open Sesame Commercial Automatic Door Opener is built for light commercial use, and the maker lists lobbies, school and restroom doors and storefronts. It opens up to 120 degrees, its closing speed adjusts for wind, and a battery keeps it working in an outage. Check local building rules for public buildings.
